In real estate, lead-based paint refers to paint that contains high levels of lead — a toxic metal once used in homes built before 1978. Federal law requires home sellers to disclose known lead hazards and provide buyers with an EPA-approved information pamphlet before closing.

Why Lead-Based Paint Disclosures Matter

Lead exposure can cause serious health risks — especially to children and pregnant women. To protect buyers, the Residential Lead-Based Paint Hazard Reduction Act (also known as Title X) requires sellers and landlords of homes built before 1978 to:

  • Disclose any known lead-based paint or hazards
  • Provide buyers with any inspection reports or records
  • Include an EPA-approved Lead Warning Statement in the contract
  • Give buyers a 10-day opportunity to conduct a lead inspection if desired
